Liability Terms

1.  It’s the owner’s responsibility for the identification of all underground utilities.  LOCAL CONCRETE SERVICES takes no responsibility for the repair of the identified or unmarked gas, electric, sewer, cable, phone or any other utilities.
2. All materials are guaranteed to be as specified.
3. All work to be completed in a quality workmanship like manner as specified in the terms of this proposal, per industry, and local building codes standards.
4. Any deviations from the proposal outlined on the side involving extra work or cost will be executed only upon written orders, and will become an extra charge over and above the original proposed estimate.
5. All agreements are contingent upon strikes, accidents or delays beyond our control.
6. The owner is to carry fire, water, tornado and other necessary insurance.  Our workers are fully covered by the General Liability Insurance.
7. The work will be fully guaranteed against any defects caused by faulty workmanship or materials for a period of 1 year.  (see Limited Warranty below)
8. It’s the owner’s responsibility to remove all shrubs, plants, and other small plants in the work area that will be salvaged.  The owner may hire LOCAL CONCRETE SERVICES to perform the duties for an extra charge beyond the original estimate.
9. The nature of concrete is that it may crack, and we will not be responsible for the repair of cracks less than 3/16 inch width.  Cracks that are larger than 3/16 inches in width will be filled with cement solution.  We do not guarantee the concrete will not crack.  We will do our best to install the concrete in a manner that will keep it from cracking.
10. Also, LOCAL CONCRETE SERVICES will not be responsible for any landscaping unless requested by the customer. Additional costs may occur.
11. Customers may rescind this contract within 72 hours.  A portion of the down payment may be retained.

Limited Warranty

The work to be performed under this agreement is warranted for 1 year after completion at the described building against all defects in material, and workmanship.  If any defects occur in the area of work described on the contract other than that caused by earthquakes, severe wind, flood, change in water table, or other Acts of God, or any similar man made conditions, that LOCAL CONCRETE SERVICES will, at no cost or expense to the owner, correct any defect in workmanship or material that may have occurred in such area.  The foregoing is our sole warranty, all other warranties, expressed or implied, including any warranty of merchantability and warranty of fitness for purpose, will be excluded.  Your exclusive warranty should be for correction of any defect in workmanship and materials, as set forth above.  In no event shall you be entitled to consequential damages, regardless of whether the claim is based on warranty, contact tort, or otherwise.

Any alteration or deviation from above specifications involving extra costs, will be executed only upon written orders, and will become an extra charge over and above the estimate.  All agreements contingent upon strikes, accidents or delays beyond our control. 

Workmen’s Compensation and Public Liability Insurance on above work to be taken by LOCAL CONCRETE SERVICES.

Note: This proposal may be withdrawn by us if not accepted within ( 3 ) business days.

SALT MUST NOT BE USED THE 1ST YEAR OR WARRANTY SHALL BE VOID.
